Moyenda Mutharika Knapp is the co-chair of Johnson & Bell’s Municipal Liability group. She concentrates her practice in municipal law, insurance coverage,  commercial litigation, and employment law.  Her municipal liability experience involves defending municipalities and police officers in employment and federal civil rights matters.  Her insurance coverage experience includes taking examinations under oath, providing coverage opinions and handling declaratory judgment and breach of contract actions arising from insurance policies, such as commercial general liability, property and casualty, homeowner’s, and personal articles policies. Ms. Knapp has substantial experience with bad faith claims, fraud claims, and environmental coverage issues.

Her commercial litigation experience includes handling breach of contract and Carmack Amendment cases arising from carrier cargo losses. Her employment law background includes reviewing and drafting separation agreements, providing employment-related opinions, and litigating employment discrimination cases. Ms. Knapp employment law experience includes matters involving the Americans with Disabilities Act, Family Medical Leave Act, reverse discrimination claims, and religious discrimination.

Ms. Knapp also writes a monthly column in the Chicago Law Bulletin entitled "Legal Look." In addition, she is actively involved in the Illinois Municipal League.

Representative Case Results:

  1. American Highway Inc. v. Northwood Associates, Inc., DuPage County
    Case No. 09 L 001104

    On August 29, 2010, Ms. Knapp obtained the dismissal with prejudice and without leave to re-file of plaintiff’s cause of action for breach of contract and negligence against its insurance broker, alleging that the broker failed to properly procure insurance to cover a parking lot at which a cargo loss occurred. 

  2. Bialas v. Maruyama, Cook County
    Case No. 09 L 13820, Trial Dates: January 13-14, 2011

    The plaintiff claimed that she suffered a right internal carotid artery dissection, with almost complete blockage of the artery; a left internal carotid artery dissection; and headaches as a result of a rear end car accident.  The plaintiff was hospitalized from July 22, 2006 through July 24, 2006.  Following her release from the hospital, the plaintiff underwent a cerebral angiogram.  The plaintiff called two treating physicians to testify. One treating physician, an endovascular neuroradiologist, testified that the dissections were evident on cerebral angiogram and were caused by the accident. The plaintiff's medical bills of $43,073.90 were reduced to $5,900.35 at trial upon Ms. Knapp's motion. At trial, the plaintiff sought recovery of the reasonable value of her medical bills plus monetary awards for pain and suffering and loss of a normal life.  She asked the jury for $55, 900 after rejecting the $7,000 settlement offer.  Plaintiff was awarded $5,900.35.   3. Eng v. Reda, Cook County
    Case No. 06 L 9356, Trial Dates:  May 16-25, 2011

    Successfully defended a demolition company at  jury trial in an action alleging property damages to a home arising from the Illinois Adjacent Landowner Excavation Protection Act and nuisance, resulting in a defense verdict against the plaintiff.   4. Hunter v. State Farm Insurance Company, Cook County
    Case No. 06 L 2809, Trial Dates:  April 28, 2008 to May 1, 2008

    Ms. Knapp's successful defense of State Farm Fire & Casualty Company in the jury trial of Hunter v. State Farm Fire & Casualty Company, a breach of contract case relating to a homeowners insurance policy, in which the jury returned a verdict in favor of State Farm Fire & Casualty Company in minutes, was reported in the National Jury Verdict Review & Analysis, Volume 24, Issue 5, May 2009.

  5. Kehoe v. State Farm Insurance Company, Appellate Court, First District, Case No. 09-0975, Cook County Case No. 07 L 008848
    Ms. Knapp's successful dismissal with prejudice of plaintiff's amended complaint for breach of contract and bad faith damages on a motion to dismiss was upheld by the Appellate Court of Illinois, First District, on March 11, 2010. Click Here for the decision.

    Case No. 06 L 010066

    June 10, 2008 dismissal with prejudice of plaintiff's breach of contract claim seeking property damages under a homeowner's policy.

  7. Sackett v. Memberselect Insurance a/k/a AAA Insurance, Kankakee County
    Case No. 05 L 151

    On June 3, 2010, Ms. Knapp obtained the dismissal with prejudice of a homeowner's claim for breach of contract and bad faith damages as a discovery sanction.
